Online Banking Terms and Conditions Agreement and Other Disclosures Electronically

In this “E-Sign Agreement to Receive the Personal or Business Online Banking Terms and Conditions Agreement and Other Disclosures Electronically” (this “Agreement”), the words “we”, “us”, and “our” mean Central Pacific Bank, and the words “you” and “your” mean each person or business requesting to enroll in our Online Banking Service (the “Service”). Please read this Agreement carefully and save or print a copy for your records. By clicking on the I AGREE AND CONTINUE button below, you are indicating that you have read and accepted the terms of this Agreement, and that you agree with us as follows:

Your Consent is Required. The Electronic Signatures in Global and National Commerce Act requires your consent before we can provide you with an electronic copy of the Personal or Business Online Banking Terms and Conditions Agreement which includes the Personal or Business Online Banking Fee Schedule (the “Online Agreement”). In addition to receiving the Online Agreement electronically, your consent will also apply to future disclosures and notices we provide to you in connection with the Service, including email notices regarding changes to the Online Agreement, Service fees or other terms, and email responses to your inquiries about your transfers and payments through the Service. In this Agreement, we will collectively call the Online Agreement and these future disclosures and notices as the “Disclosures”. Therefore, you must click on the I AGREE AND CONTINUE button at the end of this Agreement indicating that you agree to receive the Disclosures electronically. You must provide your consent before you continue with the Online Service enrollment process. After you enroll in the Online Service, you may view and print updated copies of the Disclosures by visiting our website at www.centralpacificbank.com.

Requesting Paper Copies. At your request, we will provide paper copies of the Disclosures to you. To request paper copies of the Disclosures, you must exit the Service enrollment process now and may contact us by visiting any one of our branches or by calling our Customer Service Center at (808) 544-0500 from Oahu, and toll free at (800) 342-8422 from the Neighbor Islands and the Continental United States. We will not charge you any fees for providing paper copies of the Disclosures.

Consenting Now, or Withdrawing Your Consent In the Future. If you agree at this time to electronically receive the Disclosures, please click on the I AGREE AND CONTINUE button at the end of this Agreement.

In the future, if you want to withdraw your consent you may do so by visiting any one of our branches or by calling our Customer Service Center at (808) 544-0500 from Oahu, and toll free at (800) 342-8422 from the Neighbor Islands and the Continental United States.

Equipment and Software Requirements. In order to view and receive the Disclosures, you will need a hardware device that can access the Internet via modem or other form of connection, such as a personal computer (“PC”) or other similar Internet device. You hardware device must run on an appropriate operating system and be capable of using Internet browser software that is compatible with your Internet service in order for you to be able to connect to the Internet. Your Internet browser software must also be able to support 128-bit encryption. To view the Disclosures, your PC monitor should be set at an 800 x 600 screen resolution and margins set at 0.50". You will also need a printer or a long-term storage device, such as your PC’s disk drive, to retain the Disclosures for future reference.

Your Email Address. You agree to provide us with a current email address so we can electronically send you the Disclosures about the Services, such as changes to the Online Agreement, the other Disclosures and responses to your inquiries. Please notify us of any changes to your email address. You may update your email address by visiting any one of our branches, requesting a change through Online Banking, or by calling our Customer Service Center at (808) 544-0500 from Oahu, and toll free at (800) 342-8422 from the Neighbor Islands and the Continental United States.
